Yola High Court Adjourns Fufore Emirate Suit to April 3 for Further Hearing

A High court sitting in Yola has adjourned the hearing to 3rd April 2025 in the suit instituted by three (3) aggrieved members of Adamawa Emirate challenging the creation of Fufore emirate by Governor Ahmadu Fintiri’s govt. In Adamawa state.
The legal team of the applicants headed by Mohammad M.Nurudeen had in Tuesday’s sitting prayed to the court for time to put a response to the earlier cross affidavit filed by the state government as the first respondent/defendant through the Attorney general of the state.
Nurudeen, SAN explained while answering questions from journalists after the sitting that, his team had made adjustments previously where the state was supposed to have responded within seven (7) days but unfortunately, it came late.
“They have applied properly under the rules of the court for an extension of time, so we have agreed to their application and the extension was granted.
“More so, they also annexed a brief argument to their motion, we need to reply because we have not had time to look at it. The court has adjourned to 3rd April 2025 for us to file our reply and take the main motion”. Nurudeen maintained.
In his reaction, the Attorney general and Adamawa state commissioner of justice, Afraimo Jingi stated that the state had earlier filed an application praying for the court to strike out the suit for not properly being constituted.
Jingi advanced that despite their application, the counsel to the applicants/plaintiffs brought another application demanding for the issues raised to be referred to the court of appeal.
“We saw that it is not a proper case to be filed to the court of appeal so we now brought up an application to file a counter affidavit. We are out of time what happened today is that our application for leave to file a counter affidavit was out of time and we also argued that this matter should not be referred to the court of appeal,” he said.
Presiding judge Justice Musa Usman after listening to the submissions of both counsels on the need to give the legal team of the respondents time to study the counter affidavit over an application filed for referring the matter to court of Appeal adjourned the case to 3rd April forthwith.
It could be recalled that as the state government created Fufore Emirate out of the old Adamawa Emirate, the three
aggrieved including; Alhaji Musa Halilu Ahmed (Dujiman Adamawa), Alh.Mustapha Dahiru Mustapha (Yeriman Adamawa), and Alhaji Mustapha Ahmed (Sarki Noma Adamawa) approached the court to challenge the process believing it to be a distortion to the heritage of the Fombina dynasty.
